The Dallas law firm Munck Wilson Mandala, LLP, is announcing the entry of an opinion and order by Judge Richard A. Schell of the U.S. District Court for the Eastern District of Texas awarding firm client, ams-TAOS USA Inc. f/k/a Texas Advanced Optoelectronic Solutions, Inc., more than $77 million in damages against Intersil Corporation (NASDAQ: ISIL), including $10 million in exemplary damages.
The decision comes after a four-week trial in which the jury found in favor of ams-TAOS on all claims against Intersil, including misappropriation of ams-TAOS' trade secrets; breach of a non-disclosure agreement; tortious interference with ams-TAOS' prospective business relations; and willful infringement of U.S. Patent No. 6,596,981.
Trial team member Michael McCabe says, "ams-TAOS always believed that a jury presented with the evidence would agree that Intersil built its competing line of optoelectronic light sensors on trade secrets taken from ams-TAOS. We are very pleased for our client."
On March 6, 2015, the jury awarded $88.7 million after finding that Intersil willfully infringed ams-TAOS' patent and two instances of conduct justifying exemplary damages. The verdict was ranked the 16th Largest Verdict of 2015 by The National Law Journal and VerdictSearch.
Munck Wilson Mandala's Jamil N. Alibhai, lead partner for ams-TAOS in the lawsuit, was named as one of only 20 attorneys in the nation as a Winning Litigator by The National Law Journal. Other members of the legal team include Kelly Chen, Robert D. McCutcheon, William A. Munck, Jessica Spaniol, Jordan Strauss, and Michael C. Wilson.
Mr. Alibhai says, "Intersil unfairly competed by using TAOS' intellectual property. Today, the justice system held Intersil responsible for its patent infringement and malicious trade secret misappropriation."
